Ayr\u0131ca yukar\u0131da da belirtti\u011fimiz gibi haftal\u0131k \u00e7al\u0131\u015fma saati de fazla mesai \u00fccreti hesaplamas\u0131nda dikkate al\u0131nmas\u0131 gereken bir konudur. \u00c7\u00fcnk\u00fc fazla \u00e7al\u0131\u015fma kapsam\u0131na giren \u00e7al\u0131\u015fmalar i\u00e7in \u00e7al\u0131\u015fan\u0131n \u00fccretinin saat ba\u015f\u0131na d\u00fc\u015fen miktar\u0131n\u0131n %50 y\u00fckseltilmesi gerekirken haftal\u0131k 45 saatten daha az \u00e7al\u0131\u015fan ki\u015filer i\u00e7in fazla s\u00fcreli \u00e7al\u0131\u015fmalarda \u00e7al\u0131\u015fan\u0131n saatlik \u00fccreti %25 art\u0131r\u0131larak fazla mesai \u00fccreti hesaplan\u0131r.&nbsp;<\/p>\n\n\n\n<p>\u00d6rne\u011fin haftal\u0131k 40 saat \u00e7al\u0131\u015fan ve ayl\u0131k br\u00fct maa\u015f\u0131 40.000 TL olan bir \u00e7al\u0131\u015fan\u0131n bir ayda toplam 5 saat fazla mesai yapt\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnelim. Ayl\u0131k i\u015f g\u00fcn\u00fc say\u0131s\u0131n\u0131 da 25 g\u00fcn olarak ele alal\u0131m. Buna g\u00f6re;&nbsp;<\/p>\n\n\n\n<p><strong>\u00c7al\u0131\u015fan\u0131n g\u00fcnl\u00fck \u00fccreti:<\/strong> 40.000 \/ 25 = 1.600 TL&nbsp;<\/p>\n\n\n\n<p><strong>Saatlik \u00fccreti: <\/strong>1.600 \/ 8 = 200 TL&nbsp;<\/p>\n\n\n\n<p><strong>Fazla mesai saatlik \u00fccreti (%25 y\u00fckseltilerek): <\/strong>200 + (200 x %25) = 250 TL&nbsp;<\/p>\n\n\n\n<p><strong>Toplam fazla mesai \u00fccreti: <\/strong>250 x 5 = 1.250 TL olur.<\/p>\n\n\n\n<p>\u015eimdi, ayn\u0131 maa\u015f, fazla mesai s\u00fcresi ve ayl\u0131k i\u015f g\u00fcn\u00fc \u00fczerinden haftal\u0131k 45 saat \u00e7al\u0131\u015fan bir \u00e7al\u0131\u015fan\u0131n fazla mesai \u00fccretini hesaplayal\u0131m;&nbsp;<\/p>\n\n\n\n<p><strong>\u00c7al\u0131\u015fan\u0131n g\u00fcnl\u00fck \u00fccreti:<\/strong> 40.000 \/ 25 = 1.600 TL<\/p>\n\n\n\n<p><strong>Saatlik \u00fccret:<\/strong> 1.600 \/ 9 = 177,78 TL&nbsp;<\/p>\n\n\n\n<p><strong>Fazla mesai saatlik \u00fccreti (%50 y\u00fckseltilerek):<\/strong> 177,78 + (177,78 x %50) = 266,67 TL<\/p>\n\n\n\n<p><strong>Toplam fazla mesai \u00fccreti: <\/strong>266,67 x 5 =1.333,35 TL&nbsp;<\/p>\n\n\n\n<p>Ancak \u015funu belirtelim: \u00c7al\u0131\u015fan\u0131n saatlik \u00fccretinin belirli bir oranda art\u0131r\u0131lmas\u0131, i\u015f g\u00fcnleri kapsam\u0131nda fazla mesai yap\u0131lmas\u0131 durumunda ge\u00e7erlidir. E\u011fer \u00e7al\u0131\u015fan, genel tatil veya resmi tatil g\u00fcnlerinde \u00e7al\u0131\u015f\u0131rsa saat ba\u015f\u0131 hesap yap\u0131lmaks\u0131z\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 her g\u00fcn i\u00e7in tam g\u00fcn \u00fccretinin \u00fcst\u00fcne bir g\u00fcnl\u00fck \u00fccreti de eklenerek \u00f6denir. Yani bu durumda \u00e7al\u0131\u015fan\u0131n g\u00fcnl\u00fck \u00fccretinin iki kat\u0131 olacak \u015fekilde \u00f6deme almas\u0131 gerekir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Fazla Mesai S\u0131n\u0131r\u0131 Var m\u0131?&nbsp;<\/strong><\/h2>\n\n\n\n<p>Fazla mesai ile ilgili merak edilen di\u011fer bir konu da fazla \u00e7al\u0131\u015fman\u0131n bir s\u0131n\u0131r\u0131 olup olmad\u0131\u011f\u0131. \u00c7al\u0131\u015fma hayat\u0131nda fazla mesai s\u0131k kar\u015f\u0131la\u015f\u0131lan bir durum olsa da asl\u0131nda ekstra \u00e7al\u0131\u015fma, s\u00fcrekli talep edilebilecek bir uygulama de\u011fil. \u00c7\u00fcnk\u00fc y\u0131ll\u0131k fazla mesai s\u00fcresinde yasal s\u0131n\u0131rlar bulunur. Kanunda da belirtildi\u011fi gibi fazla \u00e7al\u0131\u015fma s\u00fcresi y\u0131lda 270 saati a\u015famaz.&nbsp;<\/p>\n\n\n\n<p>Ayr\u0131ca i\u015f s\u00f6zle\u015fmesinde bu konuyla ilgili bir ibare bulunmad\u0131\u011f\u0131 m\u00fcddet\u00e7e fazla \u00e7al\u0131\u015fma i\u00e7in i\u015fverenlerin \u00e7al\u0131\u015fanlardan onay almas\u0131 gerekir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Fazla Mesai S\u0131n\u0131r\u0131 A\u015f\u0131l\u0131rsa Ne Olur?&nbsp;<\/strong><\/h2>\n\n\n\n<p>Diyelim ki y\u0131ll\u0131k olarak belirlenen fazla mesai s\u00fcresi a\u015f\u0131ld\u0131. Peki, \u015fimdi ne olacak? B\u00f6yle bir durumda kanun \u00e7er\u00e7evesinde belirlenen yasal s\u0131n\u0131r a\u015f\u0131ld\u0131\u011f\u0131 i\u00e7in \u00e7al\u0131\u015fanlar\u0131n hakk\u0131 ihlal edilmi\u015f olur. Bu hak ihlali de \u00e7al\u0131\u015fan a\u00e7\u0131s\u0131ndan hakl\u0131 fesih nedeni olarak say\u0131l\u0131r. Bu nedenle herhangi bir hak ihlali ile kar\u015f\u0131la\u015fmamak i\u00e7in hem i\u015fveren hem de \u00e7al\u0131\u015fan olarak fazla mesai s\u00fcrelerine dikkat etmek olduk\u00e7a \u00f6nemli.<\/p>\n\n\n\n<p>Fazla \u00e7al\u0131\u015fma s\u0131n\u0131r\u0131 d\u0131\u015f\u0131nda g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresinin s\u0131n\u0131r\u0131 da fazla mesaide dikkat edilmesi gereken bir konu. \u00c7\u00fcnk\u00fc \u0130\u015f Kanununun 63. maddesinde de belirtildi\u011fi gibi \u00e7al\u0131\u015fanlar\u0131n g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi 11 saati a\u015famaz. \u00d6rne\u011fin g\u00fcnl\u00fck 9 saat \u00e7al\u0131\u015fan bir ki\u015finin en fazla 2 saat fazla \u00e7al\u0131\u015fma s\u00fcresi olabilir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Fazla Mesai Kar\u015f\u0131l\u0131\u011f\u0131 \u0130zin Olarak Kullan\u0131labilir mi?&nbsp;<\/strong><\/h2>\n\n\n\n<p>G\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresine ek olarak \u00e7al\u0131\u015fan ki\u015filer, fazla mesai \u00fccreti talebinde bulunabilir. Ancak fazla \u00e7al\u0131\u015fma durumunda \u00e7al\u0131\u015fanlara sunulan se\u00e7enek sadece \u00fccret de\u011fildir. \u00c7\u00fcnk\u00fc \u00e7al\u0131\u015fan talep ederse ek \u00e7al\u0131\u015fma saatlerini, daha sonras\u0131nda serbest zaman olarak kullanabilir.&nbsp;<\/p>\n\n\n\n<p>Serbest zaman s\u00fcresi ise fazla \u00e7al\u0131\u015fma ve fazla s\u00fcreli \u00e7al\u0131\u015fma kapsam\u0131na g\u00f6re de\u011fi\u015fir. E\u011fer \u00e7al\u0131\u015fan fazla \u00e7al\u0131\u015fma kapsam\u0131nda fazla mesai yapt\u0131ysa \u00e7al\u0131\u015ft\u0131\u011f\u0131 her saat kar\u015f\u0131l\u0131\u011f\u0131nda 1 saat 30 dakika serbest zaman hakk\u0131 olur. Fazla s\u00fcreli \u00e7al\u0131\u015fmada ise \u00e7al\u0131\u015fanlar\u0131n her saat kar\u015f\u0131l\u0131\u011f\u0131nda serbest zaman\u0131 1 saat 15 dakikad\u0131r.&nbsp;<\/p>\n\n\n\n<p>K\u0131sacas\u0131 fazla mesai, \u00e7al\u0131\u015fma hayat\u0131nda s\u0131k\u00e7a kar\u015f\u0131la\u015f\u0131lan bir durum olsa da haklar\u0131n\u0131z\u0131 ve y\u00fck\u00fcml\u00fcl\u00fcklerinizi bilmek i\u00e7in t\u00fcm bu detaylara hakim olmak olduk\u00e7a \u00f6nemli.
