Statutory Earthquake Insurance

Article 2 of the Decree with Force of Law No. 587 on Statutory Earthquake Insurance requires the following buildings to be covered by insurance:
•    Buildings constructed as housing on privately owned real estate registered in the title deed registry.
•    Detached sections covered by Apartment Ownership Law No. 634.
•    Detached sections included in such buildings, used for business, office and similar purposes.
•    Houses built by or funded with the loans extended by the state as a response to natural disasters.
Buildings that meet the abovementioned requirements and where construction servitude is established, buildings which are registered on the title deed registry as “plot, etc.” lacking classification and cooperative units whose title deeds have not yet been issued should also be covered by Statutory Earthquake Insurance. Insurance of housing units lacking an autonomous title deed registration can still be made on the basis of the insurance holder’s statement and the details specified on the title deed for the plot.

Buildings not required to be covered by Statutory Earthquake Insurance are as follows:
•    Buildings owned by government authorities and agencies.
•    Buildings in village settlements.
•    Buildings used exclusively for commercial and industrial purposes (office buildings, commercial buildings, administrative buildings, educational buildings, etc.)
•    Buildings whose construction has yet to be completed.
•    Detached sections and buildings built as housing after 27 December, 1999, but lacking construction permit within the framework of applicable regulations.
•    Buildings constructed on land and plots not registered in the title deed registry and which are not owned privately (such as treasury land).
Given the lack of municipal oversight over the buildings in village settlements and the general low level of income among their residents, as well as the difficulties of offering insurance in such areas, insurance is not pushed as a statutory requirement in such areas. However, it is possible to procure Discretionary Earthquake Insurance from our firm at your own will for buildings in such areas. In a similar vein, even though buildings used for commercial and industrial purposes are also not covered by the statutory requirements, it is still possible to procure Discretionary Earthquake Insurance from our firm for such buildings as well.

Compulsary Earthquake Insurance is extended solely on the basis of a declaration. All liability arising from false declarations shall rest with the insurance holder.
•    Insured’s name, address, phone number, and if available, mobile phone number
•    Insured’s Tax ID No. and Republic of Turkey ID No.
•    Insured property’s address
•    Title deed registry details (block, plot, parcel, page no.) (house or plot title deed)
•    Year of construction (1975 or earlier, 1976-1996, 1997-1999, 2000 or later)
•    Construction style of the building (steel/concrete framework, masonry, other)
•    Overall floor count of the building
•    Damaged status of the building (no damage, mild damage, medium damage)
•    Gross surface area of the house (flat) (m²)
•    Usage type of the house (flat) (housing, commerce, office, other)

Compulsory Earthquake Insurance provides TCIP’s coverage up to the insurance value for any material damage the following incidents may cause on the insured buildings (including damages arising on the foundations, main walls, shared walls separating detached sections, ceilings and floors, stairs, platforms, corridors, roofs and chimneys).
•    Earthquakes
•    Fire caused by earthquakes
•    Explosions caused by earthquakes
•    Landslides caused by earthquakes

The objective of Statutory Earthquake Insurance is to provide a minimum standard coverage figure. Hence why TCIP extends coverage up to a maximum figure established each year in parallel with the increase in building costs. The maximum coverage figure provided by TCIP was set as 150,000 TRY for all building types, taking effect from 01.01.2009 onwards. When setting the maximum coverage figure, the reconstruction cost of the buildings (excluding the plot value) that makes up the largest portion of the existing building inventory is taken into consideration. Coverage figures for the insurance holders (sum insured) are set with reference to the size of the abode and the type of construction, up to the abovementioned maximum coverage figure. If the abode’s value exceeds the coverage provided by TCIP the Insured can still obtain discretionary supplementary coverage from our firm for the exceeding part.

The insurance premiums are set in line with 3 factors:
•    The earthquake risk zone where the building is located.
•    Construction type of the building.
•    Gross surface area of the house. The insurance premium is higher in high-risk zones and lower in low-risk zones.
In this context, there are 15 tariff steps with reference to 5 risk zones and 3 construction types:

The risk zones for earthquakes are delineated on the basis of the “Earthquake Regions of Turkey” map prepared by the Ministry of Development and Housing. The building types mentioned in the tariff above are defined as follows:
•    Steel, concrete framework structures: These are buildings incorporating a steel or concrete framework.
•    Ordinary masonry structures: These are buildings lacking a framework, and made of dry rubble, masonry, brick or concrete briquettes in their carrier walls, equipped with concrete or ferro-concrete flooring, stairs, and ceilings.
•    Other Buildings: These are the buildings that cannot be categorized under the groups specified above.
TCIP renewal discount applies as follows:
Article 2 of the Statutory Earthquake Insurance Tariff and Instructions published on 29 December, 2012 reads, “With effect from 1.3.2014 onwards, if the insurance is renewed within a maximum of 30 days following the expiration of the policy, a discount of 10% for the first renewal and 20% for the second renewal shall apply on the tariff prices stipulated above.  A rate of 20% shall apply for any subsequent renewals following the second one.” Accordingly the renewal discounts shall be effected in tiers from 01.03.2014 onwards.
The examples describing the Renewal Discount Tiers are provided below with reference to the new tiered discount rates for any renewals to be effected by our firm on TCIP policies issued by both our firm and other Insurance Firms with a “processing date” and “renewal policy commencement date” of 01.03.2014 or later referring to the date of renewal, are provided below.

Entities receiving claim reports:
The Insured who has a Statutory Earthquake Insurance policy and whose home has been damaged in an earthquake shall be required to file an application with one of the following entities in order to have their claims covered as soon as possible:
